Terms of Service

By creating an account or using Backpack (“the Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a binding agreement between you and the team operating Backpack (“the Developer”).

1. The Service

Backpack is a personal link-saving tool provided as-is, on a best-effort basis. The Developer reserves the right to modify, suspend, or discontinue the Service — or any part of it — at any time, for any reason, with or without notice. The Developer is under no obligation to maintain the Service or to provide any particular level of availability, uptime, or features.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to use the Service. The Developer may terminate or suspend your account at any time, for any reason, including violation of these Terms, with or without notice.

3. Your Content

You retain ownership of any links, tags, and other content you save to the Service (“Your Content”). By using the Service, you grant the Developer a limited, non-exclusive license to store and display Your Content solely for the purpose of providing the Service to you. The Developer does not sell or share Your Content with third parties for advertising purposes.

You are solely responsible for Your Content. You represent that you have all necessary rights to the URLs and content you save, and that doing so does not violate any applicable law or any third party’s rights.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any law or regulation
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Use the Service to distribute spam, malware, or other harmful content
  • Reverse engineer, decompile, or otherwise attempt to extract the source code of the Service
  • Use automated tools to scrape, crawl, or overload the Service
  • Misrepresent your identity or affiliation with any person or entity

5. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. The Developer does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. The Developer does not warrant that any data you store will be preserved or recoverable.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of business, or loss of goodwill, arising out of or in connection with your use of or inability to use the Service, even if the Developer has been advised of the possibility of such damages.

The Developer’s total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid the Developer in the twelve months preceding the claim.

7. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third party’s rights.

8. Data and Privacy

The Service uses third-party infrastructure providers (including Supabase for authentication and database storage, and Vercel for hosting). Your data is stored and processed by these providers subject to their own privacy policies. The Developer implements reasonable security measures but cannot guarantee absolute security. You use the Service at your own risk.

The Developer may collect basic usage information (such as account creation date and feature usage) to operate and improve the Service. The Developer does not sell this information.

9. Changes to These Terms

The Developer may update these Terms at any time. If the Developer makes material changes, the “Last updated” date above will be revised. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

11. Miscellaneous

These Terms constitute the entire agreement between you and the Developer regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force. Failure to enforce any right under these Terms does not waive that right. You may not assign your rights under these Terms; the Developer may assign its rights freely.
